Privacy Policy
I. Uses and Disclosures for Treatment, Payment, and Health Care Operations
Healing with Grace – Counseling and Ketamine Center may use or disclose your protected health information (“PHI”) for purposes of treatment, payment, and health care operations, as permitted by federal law.
Treatment includes providing, coordinating, or managing your mental health care. This may include consultation with clinicians, supervisors, student interns, or administrative staff involved in your care.
Payment includes billing, reimbursement, collections, and eligibility verification.
Health Care Operations include practice management activities such as quality assurance, clinical supervision, training, licensing, accreditation, audits, and business administration.
We are required by law to:

We reserve the right to revise this Notice at any time. Any updated Notice will apply to all PHI we maintain. Updated versions will be available upon request and through our intake system.
II. Uses and Disclosures Requiring Written Authorization
We will use or disclose PHI only with your written authorization for purposes outside of treatment, payment, and health care operations, unless otherwise permitted or required by law.
An authorization is written permission allowing us to disclose specific information for a specific purpose.
Certain clinical documentation created during counseling sessions is afforded additional protection under federal law and is maintained separately from the general medical record. We will obtain your specific written authorization before releasing this information, except as permitted or required by law.
You may revoke an authorization at any time in writing, except to the extent that:

We have already relied on the authorization; or

The authorization was obtained as a condition of insurance coverage and the law permits the insurer to contest the claim.
III. Uses and Disclosures Without Consent or Authorization
We may use or disclose PHI without your consent or authorization when required or permitted by law, including:

Suspected child abuse or neglect

Suspected elder or dependent adult abuse or neglect

Health oversight activities, including licensing or regulatory investigations

Judicial or administrative proceedings, including valid court orders

When necessary to prevent a serious threat to health or safety

Workers’ compensation claims, if applicable

As otherwise required by federal or Nevada law
IV. Special Protections for Reproductive Health Care Information (2026 Update)
Federal law now provides additional protections for PHI related to lawful reproductive health care.
Healing with Grace will not use or disclose PHI for the purpose of:

Investigating or imposing liability on any person for seeking, obtaining, providing, or facilitating lawful reproductive health care

Identifying individuals for such investigations or proceedings
In certain situations, we may be required to obtain an attestation before responding to certain legal or administrative requests for PHI involving reproductive health care.

V. Confidentiality of Substance Use Disorder (SUD) Records (Part 2 Alignment)
Some health information related to substance use disorder treatment may be subject to additional confidentiality protections under federal law (42 CFR Part 2), as incorporated into HIPAA.
When applicable, these records may require specific authorization or additional restrictions on redisclosure.
VI. Notice Regarding Redisclosure of Information
PHI disclosed under this Notice may be subject to redisclosure by the recipient and may no longer be protected by the HIPAA Privacy Rule once released outside of HIPAA-covered entities.

VII. Your Rights Regarding Your Protected Health Information
You have the following rights regarding your PHI:

You may request limits on certain disclosures. We are not required to agree to all requests but will comply when legally required.

You may request a list of certain disclosures made by our practice.

You may request a paper copy of this Notice at any time.
VIII. Breach Notification
You will be notified if a breach of your unsecured PHI occurs, as required by federal law.
IX. Complaints and Contact Information
If you believe your privacy rights have been violated, you may file a complaint with us or with the U.S. Department of Health and Human Services. You will not be retaliated against for filing a complaint.
